The No Surprises Act: what it means for anesthesia billing

Anesthesia was one of the main targets of surprise billing rules. If you're out of network anywhere, this matters.

The basic rule

For emergency care, and for many services at in-network facilities, out-of-network providers can't bill patients more than their in-network cost sharing. Anesthesia is one of the services covered, and anesthesia providers generally can't ask patients to waive that protection.

How you're paid instead

The plan pays you directly. If you disagree with the amount, there's an open negotiation period and then a federal independent dispute resolution process.

What to do

  • Know which facilities and plans you're out of network with
  • Don't balance bill patients in protected situations
  • Track out-of-network payments and use negotiation where it's worth it
  • Meet the process deadlines, which are short
