What to check in an anesthesia services agreement

Before you sign with a surgery center or office, go through this list. It's much easier to fix terms now than later.

The checklist

  1. Who bills. You, the facility, or a mix? In whose name?
  2. Exclusivity. Are you the only anesthesia provider? Can the facility bring in others?
  3. Coverage. Which days, which rooms, what hours, and what happens when cases run late?
  4. Stipend. If there is one, how is it calculated and when is it reviewed?
  5. Equipment and drugs. Who supplies, maintains and pays for them?
  6. Insurance. Required malpractice limits.
  7. Term and renewal. How long, and does it renew automatically?
  8. Termination. How much notice, and for what reasons?
  9. Non-solicitation. Can either side hire the other's staff?
  10. Data. Who owns anesthesia records and billing data?

Have a healthcare lawyer review the final version.
